Terms of Service

By accessing or using PassionExplorer (the "Service"), you agree to these Terms of Service ("Terms"), forming a binding agreement between you and Chameleon Strategies, Inc., the company that operates PassionExplorer. These Terms apply together with the Privacy Policy and the Imprint.

1. Acceptance of Terms

By accepting these Terms, you represent that you have reached the age of majority in your province, state, or country of residence. If you are below the age of majority, your use of PassionExplorer is only valid with the consent of your parent or legal guardian.

2. About PassionExplorer

PassionExplorer is an AI-powered travel discovery and trip planning platform that helps travellers find destinations matched to their passions and interests, access destination deep-dives, and generate personalized itineraries. PassionExplorer is a venture of Chameleon Strategies, Inc., a company incorporated in the Province of British Columbia, Canada.

3. User Accounts

To access most features of PassionExplorer, you must register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not create more than one account per person, create an account using another person's identity, or transfer your account to another person without our written consent.

4. Subscription Plans and Billing

4.1 Plans

PassionExplorer offers three plans: Explorer (free), Adventurer, and Globalist. Features and usage limits for each plan are described on the Pricing page.

4.2 Pay-per-use itineraries

Explorer users may purchase individual AI-generated trip itineraries for a one-time fee (currently USD 2.50 per itinerary, subject to change). These purchases are non-refundable once the itinerary has been generated.

4.3 Subscription billing

Adventurer and Globalist subscriptions are billed on a monthly or annual basis. By starting a subscription, you authorize us to charge the payment method you provide on a recurring basis until you cancel.

4.4 Auto-renewal

Subscriptions automatically renew at the end of each billing period. You can cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period.

4.5 Refunds

We offer a 14-day money-back guarantee on new paid subscriptions. After the 14-day window, subscription fees are non-refundable except where required by applicable law. Pay-per-use itinerary purchases are non-refundable once the itinerary has been generated.

5. AI-Generated Content

PassionExplorer uses AI to generate itineraries, destination content, and recommendations. AI-generated content may be inaccurate, incomplete, or out of date. You are responsible for verifying all information before relying on it for travel planning. See our Disclaimer for full details.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or otherwise extract data from the Service without written permission
• Use the Service to distribute spam or unsolicited commercial communications
• Impersonate any person or entity or misrepresent your affiliation

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by Chameleon Strategies, Inc. or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

AI-generated itineraries and content you generate through the Service may be used by you for personal, non-commercial travel planning purposes.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we determine your use poses a risk to the Service or other users. You may close your account at any time through your account settings.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Chameleon Strategies, Inc. and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of British Columbia, Canada.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
